Thanks to several of you I found that the government code which allows this is 53245. I am attaching the policy that our City Attorney prepared for us. I would highly recommend that those of you who do not have this form adopt a version of this I would not want any of you to go through what we just had to do with the sudden death of an employee without a spouse or a will.
